Passed by the House, stalled in the Senate: the CLARITY Act record of September (month 9) 2026
A record of the digital-asset market-structure bill that passed the House in July (month 7) 2025 and stalled on a failed September (month 9) 15, 2026 Senate procedural vote, with the measures the SEC and CFTC issued under their own authority.

From House passage to the Senate procedural failure
H.R. 3633, the digital-asset market-structure bill (CLARITY Act), passed the House 294 to 134 on July (month 7) 17, 2025. On May (month 5) 14, 2026, the Senate Banking Committee advanced it 15 to 9, and after the August (month 8) recess the Senate rejected cloture on the motion to proceed 49 to 50 on September (month 9) 15. That was 11 votes short of the 60 needed to end debate, so formal debate never began.
Regulators acted on their own two days after the vote
On September (month 9) 17, the SEC announced an Innovation Exemption for tokenized stock while the CFTC Market Participants Division issued a no-action position for passive trading software. The CFTC chairman later said, in the advance notice for Regulation CTX and CAM, that the agency was using existing authority because Congress had not passed the bill. With legislation stalled, each regulator pursued clarity under its own authority.
Enactment is not the same as clarity: the rulemaking gap
Even after enactment, the practical questions of qualifying custodians, classification standards, and reporting duties would be settled in agency rulemaking. There is no single effective date for advisers to wait for, and a statute can be in force while detailed rules are still unwritten. Treating bill passage alone as the trigger for institutional inflows skips the rulemaking timetable.
A failed procedural vote is not a failed bill
Cloture decides whether to end debate and begin consideration; it is not a vote on the bill itself. Without 60 votes, debate never opens, so 49 to 50 means a failure to proceed rather than a verdict on the bill's contents. A later session could try again, but the same disputes (ethics, stablecoin rewards, money-laundering language, DeFi jurisdiction) would need resolution.
No verdict on price causes or future legislation
This record organises the legislative timeline and agency announcements; it does not establish this episode as the cause of a Bitcoin price decline. The stablecoin bill (GENIUS Act) was enacted separately on July (month 7) 18, 2025 and should not be confused with market-structure legislation. The bill status can change in later sessions, so developments after the research point (October (month 10) 2026) need separate confirmation.
